If your business holds a Series 6 or Series 12 liquor license and serves alcohol on more than three days a month between midnight and 2 a.m., you fall under the Drink Spiking Prevention program.  Here's what that means of you, broken into two parts; what's needed if you want to be certified for a rebate.

Every qualifying establishment needs to:

1. Post signage in every restroom. The sign has to go somewhere prominent and easy to spot, not tucked away, and it needs to carry the required message (or one the Chief of Police has approved as substantially similar) in lettering at least a quarter inch tall.
   
   
2. Make drug testing kits available to customers. During regular business hours, you'll need to offer unexpired, lab-certified testing strips, stickers, or similar devices for sale or free distribution, priced at no more than 150% of what they cost you.

Want to be eligible for a rebate on a portion of your liquor license tax? You'll need to do everything above, (the Basics in 1 & 2) plus:

1. Offer free lids or covers. Every time a beverage is served, give the customer either a container with a lid, or a lid/cover that fits over the rim, at no charge.
   
   
2. Keep your testing kit inventory well stocked and properly stored. Follow the manufacturer's storage guidelines so kits stay effective.
   
   
3. Submit a quarterly attestation. Each quarter, confirm in writing that you're meeting all of the requirements above. This attestation is what keeps you on track for rebate eligibility.

Meeting these requirements consistently is what qualifies your establishment for a portion of your liquor license tax back as a rebate. Questions about how the rebate is calculated should go to the Tax and License division.

You must:

• Have at least 10 unexpired, lab-certified drink spike detection kits available at the beginning of each business day.
• Restock within three business days if your inventory falls below 10 kits.

The ordinance requires establishments to provide unexpired, lab-certified drink spike detection kits that are designed to detect common drink-spiking substances.

You may purchase qualifying kits from the vendor of your choice. As part of the program launch, the City of Tempe is providing eligible establishments with kits from Knope and Think Twice, both of which meet the ordinance requirements.

Always follow the manufacturer's instructions and replace kits before their expiration date.

No, you may:

• Provide kits free of charge, or
• Sell them to customers.

If you sell kits, the price may not exceed 150% of your cost.

Covered establishments must post the City's drink spiking awareness signs in every restroom where they are clearly visible to customers.
