This page provides information and resources for bars and restaurants that qualify under Tempe City Code Section 26-71, including program requirements, registration, compliance reporting, and educational materials.

Program Overview

Tempe is the first city in Arizona to adopt a drink spiking prevention ordinance.

The ordinance helps bars, restaurants and nightlife establishments create a safer experience for customers by increasing access to drink spike detection tools and information.

Does this ordinance apply to my business?

The ordinance applies to establishments that:

  • Hold a Series 6 or Series 12 liquor license, and
  • Serve alcohol between 12 a.m. and 2 a.m. on more than three days per month.

If your establishment meets both of these criteria, you are required to comply with the ordinance beginning Aug. 1, 2026.
