Licensing • Requirements • Approval Process

Off-Track Betting (OTB) establishments are businesses where customers can place wagers on horse, harness, or dog races—or any race, contest, or sports event—using a computerized totalisator (“tote”) system.

All OTB locations must be licensed by both the
Arizona Department of Gaming (ADG) and the City of Tempe Tax & License Division.

🧩 Key Terms

🖥️ Tote Machine (Totalisator)

A computerized system that collects wagers, records sales, calculates payouts, and displays wagering data inside the OTB establishment.

💵 Parimutuel Betting

A pooled betting system where all wagers of a certain type go into one pool. After taxes and house fees (“vigorish”) are deducted, the remaining pool is divided among all winning bets.

✅ Step 1 — Apply for a Tempe OTB Establishment License

A Tempe OTB Establishment License is required every year and must include information for all owners.
License validity: July 1 – June 30
Renewal deadline: June 1 (NOTE: this date is different than all other Regulatory licenses)

📄 Step 2 — Gather Required Documents

Before applying, ensure the following items are prepared or in progress:

🏛️ Arizona Department of Gaming (ADG)

Apply for the appropriate ADG OTB Establishment License.
ADG will only grant final approval after Tempe completes background reviews and City Council approves.

🧾 Transaction Privilege Tax (TPT) License

A TPT License from AZTaxes.gov is required annually for any food or alcohol sales within the establishment.

✔ Applies to: restaurants, lounges, bars, caterers, food vendors, and similar businesses.

👤 Step 3 — Complete Fingerprinting

All owners and applicants must submit fingerprints for a Tempe Police background check.

Required Items

  • USDOJ FBI Fingerprint Card (FD-258 – blue/white)

  • $22 DPS fee (cashier’s check or money order only)

  • Licensing Fingerprint Form (from packet)

Fingerprinting can be completed at any fingerprinting service in the U.S.
Tempe PD provides free fingerprinting for business license applicants (call for availability).

💵 Fees

New License:

  • $200 Application Fee (non-refundable)

  • $1,200 Annual License Fee (includes up to 4 tote machines)

  • $400 per additional tote machine or betting window

Total Minimum: $1,400

Accepted Payments

  • ✔ Visa, Mastercard, Discover, American Express (phone or in person)

  • ✔ Check (mail or in person)

  • ✘ Cash not accepted

Approximately 60 days
(From the date all required documents have been received.)
