🚚Mobile Merchant License Overview

A Mobile Merchant is anyone selling tangible goods—such as food, drinks, or retail items—from or next to a vehicle.
This includes:

  • Food Trucks

  • Mobile Vendors

Does NOT include:
Scheduled food delivery services that deliver to homes at least once every 7 days.

1️⃣ Before You Apply: Required Documents

✔ Transaction Privilege Tax (TPT) License

Required annually for all mobile merchant businesses.

  • Restaurant TPT Classification:
    For businesses preparing or serving food or drink (restaurants, bars, caterers, street vendors, food trucks).

  • Retail TPT Classification:
    For selling tangible personal property (clothing, gifts, jewelry, etc.).

👉 Apply, file & pay TPT through AZTaxes.gov

✔ Insurance Certificate

Must include:

  • At least $1,000,000 combined single limit per occurrence

  • Coverage for:

    • Contractual liability

    • Personal injury

    • Property damage

    • Products & completed operations

  • City of Tempe listed as insured

  • Aggregate limit must apply separately or be 2× per-occurrence limit

✔ Digital Headshot Photo

✔ Maricopa County Health Requirements (for food trucks & food units)

Required:

  • Mobile Food Permit

  • Certified Food Protection Manager (CFPM) certificate

    • Must be visible or easily accessible

    • CFPM must be present or reachable electronically during operation

  • Food Handler Certificates (all food-handling employees)

    • Valid for 3 years

    • Must be visible or accessible

2️⃣ Apply for a Tempe Mobile Merchant License

A separate annual license is required for:

  • The business

  • Each owner

  • Each non-owner driver/operator

🗂️ How do I apply?

Apply online at tempe.gov/licenseportal

👉 Food handlers do not need their own Tempe license, but their food handler certificates must be submitted at annual renewal.

3️⃣ Fingerprinting Requirements

All applicants must submit fingerprints for a Tempe Police background check.

How to complete fingerprinting:

  • Use any fingerprinting service in the U.S.

  • Tempe Police offers free fingerprinting for license applicants

    • Call 480-350-5300 to confirm availability

Items required:

  • USDOJ FBI Fingerprint Card (FD-258)

  • $22 fee (cashier's check or money order, payable to Arizona Dept. of Public Safety)

  • Completed Licensing Fingerprint Form

  • Place all items in a sealed envelope
