Tempe City Code §16A-1 to §16A-39

An Auction House is a business where property is received from individuals or companies and resold—publicly or privately—to the highest bidder for cash, goods, or other consideration.

🧾 STEP 1 — Prepare Required Documents

Before applying, ensure the following items are complete or in progress:

🏷️ Transaction Privilege Tax (TPT) License

Required annually for all auction houses.
Retail activity includes the sale of any tangible personal property (automobile, motorcycle, furniture, jewelry, appliances, collectibles, equipment, etc.).

🔎 LeadsOnline Account

A LeadsOnline account must be established prior to licensing.
Tempe Police will verify the account during the background check.

📝 STEP 2 — Apply for a Tempe Auction House License

Required annually and must include:

🏢 Business Application

👤 Owner Application (for each owner)

📌 All Regulatory Licenses must be renewed before January 1 each year.

🏛️ STEP 3 — Obtain a Tempe Use Permit

A Use Permit from the Planning Division is required.

🔗 APPLY FOR A USE PERMIT

Under the Tempe Zoning & Development Code (ZDC), a Use Permit is required for businesses operating as a pawnshop, including auction houses, in defined zoning districts.

🖐️ STEP 4 — Fingerprinting & Background Check

Fingerprints are required for all applicants to allow Tempe Police to complete a background investigation.

✔️ Requirements

  • FBI Fingerprint Card (FD-258) — blue & white

  • $22 fingerprint fee (cashier’s check or money order payable to Arizona Dept. of Public Safety)

  • Licensing Fingerprint Form (included in packet; completed by fingerprint technician)

Place all items into a sealed envelope and return to:

$50 Annual License Fee per Business
(due January 1 each year)
Fee reduced to $35 after June 30
