In accordance with the Tempe Zoning and Development Code (ZDC), the Hearing Officer:

Makes decisions on:

• Use Permit applications

Conducts public hearings:

• Receives evidence and public testimony related to applications within the Hearing Officer’s authority
• Evaluates requests based on applicable approval criteria set forth in the ZDC

Additional Authority

• May impose conditions of approval necessary to carry out the intent of the ZDC

Decisions of the Hearing Officer may be appealed in accordance with the Tempe Zoning and Development Code. Appeals of Use Permit decisions are heard by the Development Review Commission.

Certain development applications are processed administratively by the Community Development Director or designee without a public hearing. The Hearing Officer’s role is limited to those applications and matters assigned by the Zoning and Development Code.

The Hearing Officer typically meets on the first and third Tuesday of the month at 5 p.m., in the Harry E. Mitchell Government Center, Tempe City Hall – City Council Chambers, 31 E. Fifth St., Tempe, unless otherwise noted on the meeting agenda.
