Arizona law requires that government entities have standing links on their website homepages to provide information about proposed changes to taxes and fees. When Tempe has such a change to report, it will be posted to this page.
NOTICE OF PROPOSED TEMPORARY SERVICE LINE FEE
In accordance with A.R.S. § 9-499.15, public notice is hereby given that the Tempe City Council is considering amending Chapter 29, Article II, Tempe City Code, relating to encroachments and other activities in public rights-of-way. By amending section 29-18 regarding the administration; enforcement of encroachments and other activities in public rights-of-way, the resolution will impose new fees for the improper notification and replacement of temporary service lines.
Installing temporary service lines is a practice used by communications companies to re-establish service or provide timely service while awaiting approval of permits from the City that are needed to install a permanent authorized underground service line. These temporary service lines need to be safely placed and removed as expeditiously as possible so as not to be a safety hazard to the public. Often, temporary lines that have not been timely removed require the City to expend resources to locate and track the public’s complaints about such service lines that pose a nuisance and safety hazard to the public. Therefore; the Tempe City Council will be considering a resolution on Thursday, April 20, 2017 at 6:00 p.m. in the City Council Chambers to impose fees upon the communications companies that don’t replace said temporary service lines in a proper and timely basis.
